TERMS AND CONDITIONS


By using MTE Communications (MTE) E-Billing, you agree to accept and abide by the terms and conditions set out below. THESE TERMS AND CONDITIONS APPLY IN FULL. IF YOU DO NOT WISH TO BE BOUND BY THEM YOU SHOULD NOT SUBSCRIBE TO E-BILLING. MAKE SURE YOU READ THEM CAREFULLY, IN FULL, BEFORE SIGNING UP.

General

  1. By using the E-Billing service, you accept that you will no longer receive a paper bill.
  2. You must have a valid e-mail account to use E-Billing. You must provide us with a valid e-mail address to which you would like notification of your bill to be sent. The accuracy of that e-mail address is entirely your responsibility and in particular, but without limitation, should that e-mail account ever become invalid or should you wish notification of your bill availability to be sent to a different e-mail account it shall be your responsibility to notify MTE. You shall remain fully liable for any bills of which notification has been sent to your previous e-mail address.
  3. MTE reserves the right to refuse use of the E-Billing service to anyone for any reason whatsoever in its absolute discretion. Further, we reserve the right to modify or discontinue (permanently or temporarily) the E-Billing service to you or all recipients at our discretion.

Liability

  1. MTE hereby excludes any and all other liabilities and/or responsibilities and disclaims any and all warranties, whether express or implied, statutory or otherwise relating to the E-Billing service, the information contained on it and/or its use. MTE shall not be liable to the Costumer in contract, tort or otherwise, including negligence for any loss of revenue, business, goodwill, anticipated savings, profit or for any financial loss whatsoever or for any indirect or consequential loss howsoever arising even if advised of the possibility of such loss or damage arising.
  2. All bills of which notification is sent to you by e-mail shall be due and payable on the "date due" of each bill. You shall remain fully responsible and liable to pay any bills of which notification has been sent to the e-mail address you have specified regardless of whether or not you access that e-mail account and read the relevant e-mail, are disconnected from your e-mail account (for any reason and whether by MTE or otherwise) or for any other reason fail to read the relevant notification.
  3. MTE cannot guarantee uninterrupted and/or reliable access to the E-Billing service and makes no guarantees whatsoever as to its operation, availability, functionality, that it will be free of error or disruption or otherwise. We will provide notice to you regarding permanent discontinuance of service where the circumstances reasonably allow. We may prevent you from using the service immediately without notice if you breach any of these terms and conditions.
  4. MTE will take reasonable care to keep any credit card or other details that you may supply us with secure. All responsibilities and liabilities are hereby excluded except gross negligence.

Customer Responsibility

  1. Should you not pay any bill on or before the date on which it is due and payable, MTE reserves the right to claim interest from the date on which it is due and payable to the date it is actually paid in full including any accrued interest. MTE also reserves the right to suspend or terminate service upon default and MTE shall not be liable for any loss, damage or inconvenience suffered by the Customer as a result of any suspension or termination of service.
  2. Bills may be paid by VISA, MASTERCARD, and DISCOVER on-line. Additional payment methods may be accepted at MTE’s discretion.
  3. If you wish to cancel use of E-Billing, you should notify us immediately by calling (208) 355-2211. We will cancel your E-Billing account within 10 days of such notification and after that date no further notification of any bills will be sent to you by e-mail. However, you shall remain fully responsible for payment in full of any bills of which notification has been sent to you on or before the date on which your E-Billing account has been cancelled.
  4. Your password should be kept secret and MTE accepts no responsibility or liability in the event that your password is used by anyone else to access your account. MTE accepts no responsibility or liability in the event that any correspondence informing you of your password is opened or read by anyone else and, in the event that you have reason to believe that anyone else knows your password, you should contact us immediately at (208) 355-2211.
  5. While MTE does not charge for the E-Billing service itself, you may be required to pay access fees and/or call charges necessary to access your e-mails to whoever provides such access to you. Your liability to pay any such charges (whether to MTE or otherwise) shall have no effect on, nor shall it affect, any of your obligations in relation to the E-Billing service.
  6. You agree to use the E-Billing service responsibly. You will not:
    1. use E-Billing for any fraudulent or other illegal purpose or to interrupt or damage our services or to make them less efficient;
    2. use E-Billing for the transmission of any defamatory, racist, blasphemous or obscene message; or
    3. do anything that affects the operability or security of E-Billing or causes unreasonable inconvenience, or offense or disruption to, MTE or any of its staff.

Other Terms and Conditions

  1. All materials (including, without limitation, all designs, text, graphics and their selection and arrangement) relating to the E-Billing service are the property of MTE. No such material may be copied or reproduced in any form whatsoever, whether physical, electronic or otherwise, without MTE's express, prior, written consent.
  2. MTE expressly reserves the right to alter these terms and conditions from time to time by posting new terms and conditions on the E-Billing service. We will make the latest version of our terms available for you to read at all times. Your use of MTE E-Billing and your access to E-Billing will be deemed an acceptance of the terms existing at the time.
  3. If any provision of these terms and conditions shall be unlawful, void or unenforceable for any reason then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
  4. These terms and conditions shall be governed by and construed in accordance with the laws of Idaho, Arizona and the United States.
